Help I need legal advice?

My home burnt down on 12-19-06, My insurance company does not want to go by my insurance policy they said I was over insured. Here it is 2-08- 07 and the only thing I have gotten from my insurance was 7500.00. If I didn't pay my primenum they would have cancelled me. How can you be over insured? I need legal advise what to do in my situation. My e-mail address is rosebud_39_59@yahoo.com. Remind you I lost everything I owned including memories of my children pictures, first tooth first haircut graduation pictures etc, other things that their money can not replace. What can I do?

Have you read your policy? I worked for health insurance and I've never heard of the phrase "over insured" used. EVER. I dealt with a car insurance company (MERCURY INSURANCE SUCKS) who only gave me 600 dollars for my toyota camry which then was worth 1700 dollars on kelly blue book...... I would say read over your policy, every page, word for word, and you will see where it says what you are covered for. Once you get that done and you know exactly what you are covered for, call them back and throw it into their faces. Always remeber that insurance companys are all risk factors.... they insure you just in case, and in this case since your ENTIRE home burnt down, you should be entitled to more than 7500 bucks. Even though you may think that insurance companies are looking out for your best interest, they arent, they are trying to make a buck on you. Try talking to different people at your insurance company, or asking to speak to a supervisor and tell the supervisor to explain word for word why you are only getting a small amount of money, and ask for documentation showing who what where when.... BY LAW THEY HAVE TO RELEASE YOUR PERSONAL INFORMATION AND ANYTHING PERTAINING TO YOU CASE.
Reply:Contact your State's "Insurance Commission," file a complaint.
Reply:Get a lawyer and then get a Public Insurance Adjuster. A PIA is an adjuster who represent YOU and boy are they effective.





A consultation with a lawyer should cost a flat fee ($50-$100) or may even be free. The lawyer can help you wade through the legalese of your Insurance Policy/Contract.





The PIA can represent you in the insurance negotiations. I'm not sure how much they charge but my parents had to get one to work through their Hurricane Charley storm damage. Only when they got a PIA did their Insurance Company pay up...

The insurance company has a contractual relationship with you. They took your money knowing the amount of your insurance coverage. The time to question the coverage was at the time the policy was written, not after you suffered a loss.





Pursue your rights, don't sign anything until it's reviewed by a lawyer or PIA, GOOD LUCK.
Reply:I think you should talk to your lawyer, or if you don't have one, then get one. This is a sirious issue that you need to fix. By the way, It depends on what type of insurance you have and the coverage that you have. For example, sometimes you have to pay a certain percent and then the company pays the rest. You need to talk to your insurance agent immediatly.
Reply:If the rebuilding cost of your home is $100,000 and you were insured for $300,000, then you are over-insured; but they would typically just pay the actual rebuilding cost anyway.





They may also have been referring to the cost of the items in your home. Most people only have market-value, not true replacement cost insurance. Which means though your TV was $1000 and it was only 3 months old, they'll only pay $550, because that is the resale value.
Reply:most lawyers will see you for free to consult the first time, I would shop around until u find one you are comfortable with and take his advise.... if there's anything u can do he'll know..... for your area anyway.....
